• “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to Park Lore and Park Lore Passholder membership (including paid and free tiers)
• “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves.
All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Through your registration to Park Lore, you agree that you have read, understand, and agree to Section 1: GENERAL TERMS OF USE (Cookies, Identities and disclaimers, Privacy, License, Linking, and Liability).
A. Cookies
We employ the use of cookies. By using Park Lore's website you consent to the use of cookies in accordance with Park Lore’s Privacy Policy. Like most modern-day interactive web sites, we use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. This is specific to Park Lore Passholders to keep your member data saved, and items in keeping your account logged in while visiting any Park Lore page or site. We do not, under any circumstances, share or sell your data to any third-party company nor will we ever.

Upon Park Lore Passholder registration, your e-mail address will be automatically enrolled in our newsletter system (provided by MailChimp) securely. Rest assured, your information is safe with us, and we will never share your e-mail address, or contact information with anyone – ever.
The Park Lore Passholder e-mail newsletter is one of the many perks associated with creating an account – however if you would like to remove yourself from receiving the e-mail newsletter, you may (at any time) by clicking “Unsubscribe” at the bottom of the newsletter. If you experience any newsletter challenges, do not hesitate to contact us.
Through your use of (and further, registration to) Park Lore, you agree that you have reviewed our Privacy Policy and that you understand and agree to it.
D. License
Material from Park Lore, or any Web site owned, operated, licensed or controlled by same, or any of its related, affiliated or subsidiary companies is the property of Park Lore. Modification of the materials or use of the materials for any commercial purpose without the prior written consent of Park Lore's administrator is a violation of Park Lore’s copyright and other rights.
In the event you download or otherwise copy any content from this Site, including but not limited to, software, articles and images incorporated into the Site (collectively, the “Content”), such Content is licensed to you by Park Lore. Park Lore does not transfer copyright in the Content to you. You only own the medium on which the Content is recorded, but Park Lore, to the extent applicable, retains all rights to the Content. Park Loft reserves the right to charge for any unlicensed content taken from our sites without prior consent, including uncredited use in derivative works (i.e. written works, YouTube videos, or other derivative works). Through your use of (and further, registration to) Park Lore, you agree that you will not:

We reserve the right at any time and in our sole discretion to request that you remove all links or any particular link to our Web site. 2. REGISTRATION, TRANSACTIONS, & ACCOUNT
Through your registration to Park Lore, you agree that you have read, understand, and agree to Section 2: REGISTRATION, TRANSACTIONS, AND ACCOUNT (Account registration, Accounts & Passes, User comments, Membership cancellation, and Account deletion).
A. Account registration
Park Lore users may register for one (1) account per person. Account sharing is not permitted, nor are multiple accounts per individual. Each Park Lore user account (paid or free) must be linked to an active e-mail address, and during registration, users must have JavaScript enabled in-browser, as well as pass automated spoof/spam monitoring services.
Upon completion of registration, users must confirm their e-mail address to activate their account. Confirmation must be completed within one calendar week (7 days) from the Park Lore account registration, otherwise the account will be automatically deleted by our server. Under certain circumstances, e-mails that appear to be fraudulent may be automatically denied, in which an automated e-mail will be sent to the user notifying them of this event, and their e-mail will be locked from creating new accounts (i.e. anti-spam measure).
B. Accounts and Memberships (including Passes)
Park Lore reserves the right to block any user from any or all services at any time and for any reason. Users who engage in inappropriate language, bully other members, distribute spam, or create a hostile environment are not welcome on Park Lore and may be removed. While Park Lore administators do their best to monitor activities on the site, it is not possible for us to review every post and communication from our users or our authors.
Park Lore is a private site, and by using it you agree to abide by the rules set forth by its staff and understand that you may be blocked or limited for violating the spirit and intent of those rules. Users and authors of Park Lore are solely responsible for the content they post and agree to hold Park Lore harmless against any claim which might result from their posting.
By creating an account on Park Lore, you agree to be subscribed to the Park Lore Newsletter (a benefit of membership) and to receive email from Park Lore (distributed by MailChimp) with up to two (2) communications per month. You may unsubscribe from this Newsletter at any time using the link provided in each, or by contacting the administrator.
Park Lore offers two kinds of accounts: free and paid.
I. Free accounts ("Day Guests," or "base accounts")
Free accounts ("Day Guests" or "base accounts") have all the same access as non-members, but may participate in comment sections in most articles, may have access to social / community features, and are automatically registered for the monthly Park Lore Newsletter. "Day Guests" are governed by these Terms of Use.
II. Paid accounts ("Passholders," "Park Lore Passes," "subscription" or "paid member" accounts)
Paid accounts ("Passholders" "Park Lore Pass," "subscription" or "paid members") gain access to additional features according to the benefits described here.
If purchasing a Park Lore Pass (paid membership or subscription), users will be automatically registered for a base (free) account, and upgrade (a.) automatically upon registration, or (b.) post-registration from the Manage My Pass page or the Become a Passholder page. At any time, you may return your account to a free account (even if your initial registration was as a paid account).
When you upgrade to a paid member account (upon registration or post-registration), you will be redirected to PayPal to process the transaction and acknowledge your agreement to a subscription or as determined by PayPal's terms of use. Upon securely checking out, you will be redirected back to Park Lore to confirm your subscription. Upon confirmation, you will be billed one installment of your member level's monthly subscription price, with most benefits of the chosen tier automatically becoming available. Subsequent payments will be automatically processed every thirty (30) days thereafter until you cancel your membership, you delete your account (see below), or your membership is cancelled or account deleted by an administator.
Once you have purchased a paid membership and should the price or availability of a Pass change, it is our policy to "lock in" your price and benefits (as applicable) for so long as the Pass is active. If your membership is cancelled for any reason, you will need to register a new Pass at the then-current price in order to regain benefits.
Through your registration as or upgrade to a paid member account (as a Park Lore Passholder), you agree that you have reviewed and understand the Passholder page in full, that you understand and accept the benefits of your chosen tier and the details, requirements, and terms thereof, that you acknowlede that all terms, conditions, and benefits including but not limited to, Park Lore Pass benefits, feature availability, pricing, Pass type availability, and site availability are subject to restriction, availability, and change or cancellation without notice and without liability at any time.
C. User comments
Certain parts of this website offer the opportunity for users to post and exchange opinions, ratings, information, material and data ('Comments') in areas of the website. Park Lore Staff does it’s best to comb the comments before they are posted, but does not screen, edit, publish or review Comments prior to their appearance on the website and Comments do not reflect the views or opinions of Park Lore, its agents or affiliates.
Comments reflect the view and opinion of the person who posts such view or opinion. To the extent permitted by applicable laws Park Lore shall not be responsible or liable for the Comments or for any loss cost, liability, damages or expenses caused and or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.
Park Lore reserves the right to monitor all Comments and to remove any Comments which it considers in its absolute discretion to be inappropriate, offensive or otherwise in breach of these Terms and Conditions.
Through your registration to Park Lore, you warrant, understand, agree to, and represent the following:
- You are entitled to post the Comments on our website and have all necessary licenses and consents to do so.
- The Comments do not infringe any intellectual property right, including without limitation copyright, patent or trademark, or other proprietary right of any third party.
- The Comments do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material or material which an invasion of privacy is.
- The Comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.
As a Park Lore Passholder, you are – under no circumstances – to post any form of rumors, or speculation anywhere on this website. You hereby grant to Park Lore a non-exclusive royalty-free license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media.
D. Membership cancellation
You may cancel or change your membership level at any time (i.e. upgrading from a base account to a paid membership or returning a paid membership to a base account).
When you upgrade an account, access and availability-based perks will become available immediately upon upgrade, and new initial payment and subsequent 30-day billing schedule will begin immediately.
In turn, when you cancel a paid membership, access and availability-based perks will end immediately upon cancellation. Note that all Park Lore Passes (paid memberships) are non-refundable and are not prorated.
E. Account deletion
If you wish to delete your account, your membership and any associated benefts will terminate at the time of deletion. Your account may be deleted by a site administrator within five (5) days of your request for deletion or by a site administrator for violations of this Terms of Use. Note that all Park Lore Passes (paid memberships) are non-refundable.
3. DISCLAIMER
Through your use of (and further, registration to) Park Lore, you agree that you have read, understand, and agree to Section 3: DISCLAIMERS.
To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:
- Limit or exclude our or your liability for death or personal injury resulting from negligence;
- Limit or exclude our or your liability for fraud or fraudulent misrepresentation;
- Limit any of our or your liabilities in any way that is not permitted under applicable law; or exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
